We would like to remind you that the Act of 11 September 2019 Public Procurement Law, in force from 1 January 2021, did not change the rules for conducting the procedure of awarding contracts with an estimated value exceeding 50,000 PLN net and, at the same time, lower than 130.000 PLN net, i.e. excluding value-added tax (VAT) in the ETC and ENI Programmes.
In line with the Programme’s rules, the principle of competitiveness should be carried out in contracts with the value of:
- more than 50.000 PLN net, i.e. excluding value-added tax (VAT), granted by partners not obliged to comply with the PPL;
- more than 50.000 PLN net, i.e. excluding value-added tax (VAT), and at the same time lower than the amounts specified in Article 2 (1) of the Public Procurement Law (i.e. lower than 130,000 PLN net), granted by partners obliged to comply with the PPL.
The content of the detailed rules concerning the award of contracts in the project for Polish partners indicates the numbers of the editorial units which refer to the provisions of no longer applicable Act of 29 January 2004 Public Procurement Law.
We would like to draw your attention to this fact and indicate the necessity to apply the applicable provisions of the PPL Act.
The necessary changes will be introduced in the Programme’s Manual as soon as possible.
